The works/goods/services can be provided only by a particular tenderer for reasons that are:
technical,
connected with the protection of exclusive rights
This contract is being awarded under the UK Public Contracts Regulations 2015 under Reg 32 where competition is absent for technical reasons (2) (b) (ii) and also, incompatibility or disproportionate technical difficulties in operation and maintenance (5) (b) (iii). The TLIS system was purchased as an ‘off the shelf’ product but since its initial implementation there has been significant modifications which has, in reality, rendered the system ‘bespoke’. The BT Service Team currently manages the system and has significant knowledge of the operation and intricacies of the system. In light of the short extension period, pending development of a replacement system, it is imperative that business continuity is maintained with the current provider.
