Explanation:

It is essential that DAERA has sufficient support services in place to ensure ongoing business delivery and to successfully manage the transition to new contract arrangements in a controlled manner. There is a need for additional contractual arrangements to be put in place to allow a controlled handover from the existing BT resources to the new supplier. The incumbent, who was previously. appointed through the NI Direct Strategic Partner Procurement, has existing knowledge of DAERA ICT systems and data, which is essential for the successful delivery of these requirements within a challenging and complex delivery programme. The value of this modification 750 000 GBP is above the EU threshold therefore the Public Contracts Regulations 2015 apply. The regulations allow for a contract to be modified without a new procurement procedure under the following circumstances which are relevant to the DAERA. requirement; . Reg 72.1. b. . for additional works, services or supplies by the original contractor that have become necessary and. were not included in the initial procurement, where a change of contractor. . i. cannot be made for economic or technical reasons such. as requirements of interchangeability or interoperability with existing equipment, services or installations procured under the initial. procurement, and. . . ii. would cause significant inconvenience or substantial duplication of costs for the contracting authority,. provided. that any increase in price does not exceed 50 per cent of the value of the original contract. A replacement contract is currently underway. This modification will enable continuity of service and controlled transition.
