Arthur Cox was successful in a competition to provide legal services to Ulster University in 2012. Ulster University had commenced work relating to the expansion of its Belfast Campus. In and around that time a number of work streams including the appointment of consultants and the building works for the first phase of the project, were progressing. As the project progressed more work streams came on board and the need for legal advice and support increased dramatically. The many contractual relationships meant that legal matters associated with the project were ( and are) multi-faceted and complex. As the provider contracted to supply legal services to the university Arthur Cox held all files and briefs associated with the project.
As the project progressed, and in common with construction projects of this size, a number of complications arose requiring the provision of more intense and specialist legal advice. Because of the highly specialist nature of that advice and the complexity surrounding relationships the University believes that it would be highly damaging for it to change legal services providers at this critical stage of the project and considers that it is justified in retaining Arthur Cox, not least for continuity, familiarity with the briefs and files and so as not to pose a risk to complex relationships.
It is the university's view that the nature of the provision of legal services to support the expansion of the Belfast Campus are such that they are a religion and continuation of similar works already entrusted to the incumbent provider. They are in respect of a ring- fenced project which was part of the original contract. It is envisaged that these services will be required until the completion of the project in 2019 and in supporting any on going litigation at that time.
